These Terms and Conditions of Use (“Terms”) govern your access to and use of www.eamari.com (the “Website”), owned and operated by Eamari Group Trust trading as Eamari (ABN 16 617 575 168) (“Eamari”, “we”, “our”, “us”).
By accessing or using the Website, you agree to be bound by these Terms. If you do not agree, you must cease using the Website immediately.
- Definitions
In these Terms:
- “Website” means www.eamari.com and all associated pages.
- “Products” means goods listed for sale on the Website.
- “Purchase Services” means the online shopping, ordering, and related services provided by the Website.
- “Member” means a registered user of the Website.
- “Supplier” means any third-party manufacturer or fulfilment partner that provides the Products.
- “ACL” / “Australian Consumer Law” refers to Schedule 2 of the Competition and Consumer Act 2010 (Cth).
- “Delivery Services” means shipping, courier, or logistics services provided by third-party carriers.
- Acceptance of Terms
By accessing, browsing, or using the Website or Purchase Services, you confirm that you:

(a) The Website provides customers with the ability to browse and purchase various Products.
(b) The Website and Purchase Services are operated by Eamari.
(c) Eamari may update these Terms at any time. Changes take effect upon publication.
- Third-Party Fulfilment Disclaimer
All the Products available on the Website are supplied and shipped by third-party Suppliers.
By purchasing through Eamari, you acknowledge:
- Product design, quality, safety, and compliance are the responsibility of the Supplier.
- Eamari does not manufacture the Products.
- Eamari’s liability for defects is limited to the extent permitted under the ACL.
- Product descriptions, photos, and specifications may vary due to Supplier updates.
- Orders may arrive in separate shipments and delivery times may vary.
- Warranty and returns may be administered in collaboration with the Supplier.
- Registration (Optional)
Registration is not required to purchase Products.
Where registration is chosen:
- You must provide accurate and current information.
- You are responsible for account confidentiality and all activity under your account.
- Eamari may suspend or terminate accounts for security breaches or misuse.
- Your Obligations as a User
You agree to:
- Use the Website lawfully and in accordance with these Terms.
- Not attempt to access restricted areas, systems, or data.
- Not engage in data scraping, automated access, or disruptive actions.
- Not misuse or interfere with the Website’s functionality.
- Not impersonate others or provide false information.
Your account is personal and non-transferable.
- Product Availability, Variations & Accuracy
You acknowledge that:
- Product colours, sizes, packaging, and materials may vary slightly.
- Suppliers may update or modify designs without notice.
- Product availability is not guaranteed until your order is accepted (see Section 9).
- Pricing, Payment & Purchase Process
(a) By placing an order, you agree to pay the displayed Purchase Price.
(b) Accepted payment methods include: Shop Pay, PayPal, Afterpay, Humm, Zip, and Laybuy.
(c) You agree to comply with the terms of the chosen payment gateway.
(d) A confirmation email is issued once payment is received.
- Order Acceptance, Cancellation & Errors
(a) Your order is an offer to purchase. Eamari may accept or decline any order.
(b) Eamari reserves the right to cancel or refuse orders due to:
- Product unavailability
- Pricing or typographical errors
- Suspected fraud or misuse
- Supplier inability to fulfil
- Incorrect customer information
(c) If your order is cancelled, you will be refunded in full.
- Fraud, Chargebacks & Unauthorised Use
You agree:
- Not to file chargebacks without first contacting Eamari Customer Support.
- Eamari may suspend accounts linked to fraudulent or abusive chargebacks.
- Fraudulent transactions may be reported to authorities and payment processors.
- Shipping & Delivery
(a) Products may ship from multiple Suppliers and may arrive separately.
(b) Delivery times are estimates and may vary due to factors beyond our control.
(c) Eamari is not liable for delays caused by couriers, customs, or external conditions.
(d) Damage claims must be supported by photo/video evidence.
(e) Courier complaints should be directed to the carrier.
- Title, Risk & Insurance
- Title to the Product passes to you once full payment is received.
- Risk transfers to you upon delivery to the shipping address provided.
- Eamari is not responsible for loss, theft, or damage occurring after delivery.
- Returns & Refunds
Refunds may be offered at Eamari’s discretion if:
- The return is requested within 7 days of receipt;
- The Product is unopened, unused, and in saleable condition;
- Return postage is paid by the customer.
Returns relating to defects are subject to the Warranty and the ACL.
- Warranty
(a) Products are provided with guarantees that cannot be excluded under Australian Consumer Law.
(b) Standard Warranty Periods:
- Furniture: 12 months
- Electronics: 12 months
- Other categories: [Add periods if required]
(c) To lodge a claim, you must provide:
- Proof of purchase
- Description of defect
- Written notice via mail or email to customersupport@eamari.com
(d) Remedies may include repair, replacement, or refund.
(e) Warranty is void where products are misused, modified, improperly assembled, or used contrary to instructions.
- Safety & Proper Usage
You must:
- Follow manufacturer instructions;
- Not modify or tamper with any Product;
- Store and handle Products safely;
- Supervise children or vulnerable users;
Failure to comply may void warranties and limit liability.
- Intellectual Property
All Website content, including text, images, logos, and code, is protected by copyright.
You may not reproduce, distribute, or publish content without written permission.
- Privacy
Your use of the Website is governed by the Eamari Privacy Policy, available on the Website.
- Disclaimer
Use of the Website and Products is at your own risk.
To the extent permitted by law:
- Eamari excludes all implied warranties;
- Eamari is not liable for indirect or consequential loss;
- Product variations and supplier changes are not grounds for compensation.
Nothing in this clause limits your rights under the ACL.
- Limitation of Liability
To the maximum extent permitted by law:
- Eamari’s total liability is limited to the Purchase Price paid;
- Eamari is not liable for loss of profit, opportunity, data, or goodwill;
- Delivery services are performed by third parties and outside our responsibility.
- Indemnity
You agree to indemnify Eamari against any claims arising from:
- Your misuse of the Website or Products;
- Your breach of these Terms;
- Content you submit or upload;
- Illegal or negligent behaviour by you or your agents.
- Dispute Resolution
Before commencing legal proceedings, parties must attempt to resolve disputes through:
- Written Notice
- Good-faith negotiation (14 days)
- Mediation in Brisbane, Australia
If unresolved, either party may pursue legal remedies.
- Jurisdiction
These Terms are governed by the laws of Australia.
Any dispute shall be heard exclusively in the courts of Victoria, Australia.
- Independent Legal Advice
You acknowledge that:
- You have had the opportunity to seek independent legal advice;
- These Terms are fair and reasonable.
- Severance
If any clause is unenforceable, the remainder of the Terms remain in effect.
